Your privacy is very important to us. This Privacy Policy describes how we handle and secure your personal information provided via The Federation of Sovereign Indigenous Nations’ (FSIN) COVID–19 Platform, powered by TryCycle Data Systems (herein referred to as the "System”). By using the System, you agree to be bound by the terms of this policy. This policy is part of our Terms of Use.

Access to and usage of the System by Clients, Providers and other users (hereafter the “User” or “You”) is subject to acceptance of this Privacy Policy.

Acceptance of Terms

By checking the “Terms and Conditions” box in our account sign-up, or downloading the FSIN COVID–19 Platform, powered by TryCycle (as defined below), you agree that you have read, understand, and accept the terms and conditions described below (the “Terms of Service”) and you agree to be bound by these Terms of Service and all terms, policies and guidelines incorporated in the Terms of Service by reference, including, but not limited to, TryCycle’s Privacy Policy. If you do not agree to this Agreement, you should not use the Services (as defined below) in any way. The Services are offered to you conditioned on your acceptance without modification of this Agreement, including without limitation, FSIN’s right to use all data collected and analyzed by the Services.

YOUR INFORMATION

Information that is collected by the System includes the following:

Personal information: We collect the email address that you provide to us during your account registration. This may also include your phone number, address and other personally identifiable information that you may choose to add to your user account profile as well as information which you choose to enter into the System, including real-time behavioral input (“Data”).

Location: Our system starts to collect location data from sources such as GPS, Wi-Fi and cell towers once you install the App and consent to the App’s tracking your location. We may also collect Accelerometer samples, Wi-Fi network IDs, activity data. You may choose to stop our collection of location data through the Settings that we provide in the App, or by removing the App from your phone.

Information from your device: This includes information about your operating system, device identifier, carrier, language, battery performance, Wi-Fi or other network connections, or other data that you permit the App to access on your device including through permissions on your device.

USE OF INFORMATION

Data: The Data you provide to the System, through use of its services will not be shared, disclosed or displayed to anyone other than yourself and your Provider whom you choose to consult by registering for the Software and thus authorize to have access to your Data. Your Provider will have access to your Data. Your Provider is fully authorized to terminate any consultation services with you at any time and will no longer have further access to your Data in event of that happening but will be enabled to retain any information that you have provided until the point of termination of services.

Contact Information: The Software will send you communications (email and other notifications), as per your notification settings, as part of essential functioning of services that you may avail. At time of registration you will be required to verify your email address. Your contact information may also be used for customer support services, should you choose to avail of them. Your contact information is not shared with any third-party service.

Anonymized data: TryCycle will analyze anonymized and aggregated data collected through the services, for purposes of evaluating the System. Such anonymized and aggregated information is not considered as personal information. TryCycle makes all efforts to be in compliance with the physical security and privacy requirements.

DISCLOSURE OF INFORMATION

We may disclose any information to government or law enforcement officials if we believe doing so is required to comply with law enforcement and legal process; to prevent or stop any illegal, unethical, or legally actionable activity; to protect your, our or other’s rights and safety.

If TryCycle becomes involved in a merger, acquisition, or any form of sale of some or all of its assets, personal information will be transferred to the new entity for the continued performance of service. We may disclose your personal information on your own request accompanied by your permission.

INFORMATION RETENTION

On receiving a request to deactivate your account, TryCycle will deactivate your account and archive your personal information. Archived information will be retained for a period of 5 years (or longer if required legally) so as to be able to comply with legal obligations. Any Data that you had authorized to be shared with your Provider through the Software, may continue to be retained by that Provider until their agreements with our services cease, as Providers may be required under applicable laws to retain information about patients for extended periods of time. Non-personally identifiable information is retained indefinitely for analytics.

TRANSMISSION AND SECURITY

All data is stored in a secure cloud infrastructure located in North America. We take all necessary measures in providing secure transmission of your personal information before it is transferred across the Internet from your personal computer or devices to our servers and in securing such personal information stored on our systems. However, you should be aware of possible risk involved in transmitting information over the Internet as no data transmission can be guaranteed to be 100% secure and of risk that others could find a way to thwart our security systems. As a result, while we strive to protect your personal information, we cannot ensure or warrant the security and privacy of personal information you transmit to us, and you do so at your own risk.

YOUR ACCOUNT INFORMATION

You are responsible for maintaining the confidentiality of your password and account information. You are responsible for all activities that occur in your account and you agree to notify TryCycle immediately of any unauthorized use of your account. TryCycle is in no way responsible for any loss that you may incur as a result of any unauthorized use of your user account and password.

Our website may contain links to other websites. The fact that we link to a website is not an endorsement, authorization or representation of our affiliation with that third party. We do not exercise control over third party websites.
